CAPITAL A BERHAD (FORMERLY KNOWN AS AIRASIA GROUP BERHAD) ("CAPITAL A" OR "THE COMPANY") - FEDERAL COURT DISMISSED MALAYSIA COMPETITION COMMISSION'S LEAVE TO APPEAL ON ITS RM10 MILLION FINE AGAINST AIRASIA BERHAD

Reference is made to the Company’s announcement dated 4 February 2016 in relation to the Competition Appeal Tribunal’s decision in favour of AirAsia Berhad, a wholly owned subsidiary of Capital A, against the RM10 million fine imposed by the Malaysia Competition Commission (“MyCC”).

 

(Unless otherwise stated, the words and abbreviations used herein shall have the same meaning as those defined in the aforesaid announcement.)


AirAsia Berhad welcomes the decision of the Federal Court on 9 February 2022 in dismissing the application by the MyCC for leave to appeal against the Court of Appeal’s decision in holding that the MyCC cannot seek judicial review against the decision of the Competition Appeal Tribunal.


The Federal Court concluded that the case is not an appropriate case for the apex court to answer the questions of law posed by MyCC and further awarded cost of RM30,000 to AirAsia Berhad.


With the dismissal of the application, MyCC’s decision which carried a RM10 million fine against AirAsia Berhad remains overturned.
